A redacted copy of the performance standards for CDC's EEO Director and HR Director, where everything is redacted except the portions that show the EEO Director and the HR Director are the responsible parties for the Hispanic barrier analysis EEO plan. Disclosing this section of their performance standards is in the public interest for four reasons. First, the underrepresentation of Hispanics at CDC has been a persistent problem for many years. Second, the public has an interest in learning about how CDC has addressed this problem. Third, the public has an interest in knowing whether the performance standards of these high-level CDC employees do or do not adequately address their responsibility in leading CDC's Hispanic barrier analysis plan. In CDC's 2022 MD715 report to EEOC (which is a public document), CDC answered yes to the question, "performance standards address the plan?" but CDC did not provide additional information such as how the standards are worded. Fourth, it is CDC's practice that an employee's performance standards never contain any personal or private information about that employee because performance standards are intended to be objective and impersonal, so disclosing them will not be an invasion of privacy. Finally, I have searched extensively and found no laws or court decisions preventing the release of an employee's performance standards.

The spreadsheet only shows the date, brief description, and target populations for each outreach activity but has no other details such as information about what CDC did at those events and how many people were reached. CDC also provided a Word document that states the number of Hispanic or Latino full-time civil service staff at CDC increased from 498 in FY19 to 645 in FY23. It also states, "The increases in CDC's Hispanic or Latino civil servant FTEs between FY 2019 and FY2023 totaled 147 for an overall 29.5% gain."

It says the Agency Plan must include (among other things) a description of how HHS "has and will decrease barriers to participation of Hispanics and Latinos in Federal employment and student engagement opportunities".
